Terms of Service

These Terms of Service ("Terms") govern your use of services provided by Quantum Creatives ("Company," "we," "us," or "our"). By engaging our services or making a payment, you agree to be bound by these Terms.
1. Services
Quantum Creatives provides ad creative strategy, production, and management services for DTC and eCommerce brands. The specific scope of services, deliverables, and timelines will be outlined in a separate service agreement or proposal provided to each client.
2. Payment Terms
Payment is due as outlined in your service agreement. All payments are processed securely via Stripe. By providing payment information, you authorize us to charge the agreed amount. Invoices not paid within the specified timeframe may result in a pause or termination of services.
3. Client Responsibilities
Clients are responsible for:
- Providing timely feedback and approvals on creative deliverables
- Supplying any brand assets, guidelines, or materials required for production
- Ensuring all information provided to us is accurate and up to date
4. Intellectual Property
Upon full payment, clients receive full ownership of all creative deliverables produced under their service agreement. Quantum Creatives retains the right to display work in its portfolio unless otherwise agreed in writing.
5. Confidentiality
Both parties agree to keep confidential any proprietary information shared during the course of the engagement. This includes business strategies, financial data, and creative concepts not yet made public.
6. Limitation of Liability
Quantum Creatives is not liable for any indirect, incidental, or consequential damages arising from the use of our services or creative deliverables. Our total liability shall not exceed the amount paid by the client in the 30 days prior to the claim.
7. Termination
Either party may terminate the service agreement with written notice as specified in the individual service agreement. Fees for work completed up to the termination date are non-refundable unless otherwise stated in the refund policy.
8. Governing Law
These Terms are governed by the laws of the applicable jurisdiction. Any disputes shall be resolved through good-faith negotiation before pursuing formal legal action.
9. Changes to Terms
We reserve the right to update these Terms at any time. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
